Terms of Use

WE WELCOME YOUR VISIT TO OUR HOMEPAGE. YOU MUST READ AND AGREE TO THESE TERMS OF USE BEFORE USING THIS WEBSITE.

TERMS OF USE

BY PROCEEDING TO USE THIS WEBSITE, YOU HAVE AGREED TO THESE TERMS OF USE. IF YOU DO NOT AGREE TO OUR TERMS OF USE, YOU MUST STOP USING THIS WEBSITE NOW, AND ARRANGE SPECIAL PERMISSION BY CALLING US AT THE TELEPHONE NUMBER BELOW.

  1. Sponsor. “We” are Chemical Data Services Corporation (CDSC), the parent company operating The Sequoia Center, a licensed California alcohol and drug recovery center, and the owner and operator of this website.

  2. Purpose. The purpose of our website is to provide general information to our invited audience on: (1) our services for evaluation or treatment for possible chemical dependency either for themselves, their family and friends and coworkers, or in the case of referring healthcare providers, for their clients and patients; (2) employment opportunities for people with the skills and licenses necessary for career advancement at our workplaces; (3) the incidence and treatment of addiction disease affecting individuals, workplaces, families and communities; and (4) the credentials and licenses for our healthcare practice.

  3. Accessibility. If you find it difficult to access information on this website, we would like to help answer your questions by a faster or more appropriate method, which you can arrange by writing or calling us at the address and telephone number below. We welcome suggestions for improvements in the accessibility of our website.

  4. Information We Collect. We collect no healthcare patient-confidential information at this website. By visiting this site and reviewing its pages within these Terms of Use you are deemed a member of our invited audience. We employ conventional website monitoring and analysis tools to review the web-hosting service logs for this site and evaluate patterns of usage and page visits to make our site more useful and convenient for future visitors. Unless you choose to use one of our email addresses or our secure “Contact” webpage to volunteer your name or other personal identifier such as a telephone number, our website monitoring tools do not collect information that identifies you other than: the name of your internet access provider, the computer machine and web browser name, the Internet “IP number” belonging to your computer or to the firewall device protecting your computer from Internet intrusions. If you choose to use the public Internet email addresses at our site, your message leaves our webserver and travels without security over the public Internet. If we receive that public Internet message, we store it on a server inside the protective firewall at our offices. If you choose to send a message from our “Contact” page, we will save whatever identifying information you send and use it to contact you later in connection with your visit to the website. What information we do collect is periodically removed from the server computers for our public website and public emailboxes, and stored at a different location on a computer protected from Internet intrusions. Without your consent, we will not disclose or sell or rent information collected from your permitted website usage to any other person or entity. If you choose to send us personally-identifiable information about you, it is transferred and used only by our staff and contractors.

  5. Uses Permitted. Our invited audience is granted a limited, nonexclusive, nontransferable, revocable permission to (1) access and use the website only in accordance with these Terms of Use; (2) view the website materials solely for internal, personal, and noncommercial purposes; and (3) print out one copy of selected pieces of information from the website for internal, personal, noncommercial purposes, so long as your printout includes all copyright and other notices.

  6. Uses Not Permitted. The scope of your permission to use this site, without other prior written permission, does not include any permission to: (1) republish, sell, rent, loan or otherwise make available in any form or by any means all or any portion of the website; (2) create compilations or derivative works of the materials on the website; (3) use the content of the website in any way that may infringe on any copyright or other intellectual property right of the creator or that content or a third-party associated with that content, (4) remove, disable, or modify any function or appearance of the website; (5) use any of the email addresses, domain names, and fax and telephone numbers on the website in a manner that enables unsolicited commercial email or forged headers or unsolicited fax and telephone calls or otherwise violates any state or federal law. Any use of the website email addresses or domain names by senders not using our own email and website host computers shall be deemed counterfeit and is strictly prohibited.

  7. No Licensed Healthcare Advice or Patient Relationship. The information on the website is of a general nature intended to help guide prospective clients and patients toward a professional caregiver who is properly licensed to evaluate and deliver treatment for chemical dependency and related disease. Website viewing is not intended to collect confidential personal healthcare information from any identified client or patient. Nothing on the website is intended or authorized to give healthcare advice to any specific client or patient, nor to create any healthcare-patient or -client relationship. Only a telephone call, confidential fax, or personal appearance by a prospective client or patient may begin the negotiation of a patient- or -client relationship. For your convenience, we offer a separate, secure “Contact” page at the website solely for the purpose of submitting an inquirer’s name and contact number for a return call by one of our staff, and not for collecting any personal healthcare information or providing any healthcare evaluation or advice.

  8. Healthcare Privacy Policy. If after agreeing to these Terms of Use, you choose to share personally-identifiable healthcare information with us, your healthcare information will be used by us in accordance with our Policy and Notice of Health Information Practices, which you link to by clicking here: Privacy Policy.

  9. Copyright. Unless otherwise noted, we reserve full title and ownership of all content on this site. Content refers to information, software, photographs, graphics and other materials which may appear on this website. Content is protected by copyrights, trademarks, and other intellectual and property rights, all of which are reserved by CDSC. We disclaim any liability to any party for the accuracy, completeness or availability of any CDSC content or other material or for any damages arising out of the use or nonuse of any CDSC content.

  10. Linking. You may provide a link only to the homepage of the website and only in a manner that does not remove or defeat any of the content of the homepage, and only on the condition that you discontinue linking immediately upon request by us. If you wish to link to this website in any other way, please contact us during business hours at the telephone number below and obtain advance written permission before doing so. We welcome authorized links that help inform our invited audience.

  11. Corrections and Errors. We do not represent or warrant that the website will be error-free, free of viruses or other harmful components, or that defects will be corrected. We do not warrant or represent that the information available on or through the website will be correct, accurate, timely, or otherwise reliable. LIMITATION OF LIABILITY AND DAMAGES. CDSC SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE WEB SITE. CDSC SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH (A) THE USE OF OR INABILITY TO USE THE WEB SITE OR THE CONTENT. TO THE EXTENT THIS LIMITATION ON LIABILITY IS PROHIBITED, CDSC’S SOLE OBLIGATION TO YOU FOR DAMAGES SHALL BE LIMITED TO $100.00.

  12. Remedies and Rights to Report. We reserve the right to investigate complaints or reported violations of our Terms of Use and to take any action we deem appropriate, including but not limited to, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your internet access provider, usage history, IP addresses and traffic information. We further reserve the right to seek all remedies available at law and in equity for violations of these Terms of Use, including but not limited to the right to block access from a particular Internet address to any of our website pages and their features.

  13. Governing Law and Nonwaiver. These Terms of Use are governed by and construed in accordance with the laws of the State of California and any action arising out of or relating to these terms shall be filed only in state or federal courts located on the San Francisco peninsula in Northern California, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action. The failure of either party to enforce any rights hereunder shall not constitute a waiver of any terms or conditions of these Terms of Use.

  14. Severability. These Terms of Use incorporate by reference all notices and disclaimers contained on the website and constitute the entire agreement between you and CDSC with respect to access to and use of the website. If any provision of these Terms of Use is found unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

  15. Updates. We reserve the right to change these Terms of Use at any time. Updated versions will appear on this website and are effective immediately. You are responsible for regularly reviewing the Terms of Use before each new use of the website. Use of the website after any such update constitutes your consent to the changes.
